SB 171 (Pavley)- Pre-Employment Exam
This bill would clarify an inconsistency in existing law by allowing physician assistants to conduct medical examinations on applicants seeking employment by a school district or a county superintendent of schools.

Status: Signed by Governor Schwarzenegger and chaptered into law by the Secretary of State. This bill took affect January 1, 2010.

AB 356 (Fletcher)- Radiography and Fluoroscopy licentiate permits for PAs
This bill would allow physician assistants to sit for the RHB-CDHCS radiography and fluoroscopy exams and be eligible for the accompanying permits.

Status: Signed by Governor Schwarzenegger and chaptered into law by the Secretary of State. While this bill took affect on January 1, 2010, regulations will have to be promulgated in order for PAs to sit for this exam.

AB 1116 (Carter)- Cosmetic Surgery
Would enact the Donda West Law, which would prohibit the performance of an elective cosmetic surgery procedure on a patient unless, prior to surgery, the patient has received a physical examination by, and has received written clearance for the procedure from, the licensed physician and surgeon or dentist performing the cosmetic surgery or another licensed physician and surgeon, or a certified nurse practitioner or a licensed physician assistant, as specified.

Status: Signed by Governor Schwarzenegger and chaptered into law by the Secretary of State. This bill took affect January 1, 2010.

AB 1542 (Health Committee)- Health Care Services
This bill would establish the Patient-Centered Medical Home Act of 2009 to encourage health care providers and patients to partner in a patient-centered medical home, as defined, relating to a centralized, comprehensive location for a patient’s medical records.

Status: Bill failed to make it out of committee

AB 2 (De La Torre)- Individual Health Care Coverage
This bill would impose specific requirements and standards on health care service plans licensed by the DMHC relating to administrative tasks such as medical underwriting, application forms, and the decision to cancel or rescind an individual’s health care coverage.

Status: Vetoed by the Governor

AB 911 (Lieu)- Emergency Room Crowding
Would require every licensed general acute care hospital to calculate and record a score, every 3 hours, to assess the crowding condition of its emergency department. Would require every licensed acute care hospital to develop and implement a full-capacity protocol for such situations.

AB 252 (Carter)- Cosmetic Surgery
Authorizes the revocation of a physician and surgeon’s license who provides elective cosmetic medical procedures or treatments in violation of the prohibition against the corporate practice of medicine.

Status: Vetoed by the Governor

SB 158 (Wiggins)- Cervical Cancer Screening
Requires health care service plan contracts and health insurance policies that provide coverage for cervical cancer treatment or surgery to also provide coverage for a human papillomavirus (HPV) vaccine beginning on January 1, 2009. CAPA worked with Senator Wiggins to add PAs to the list of providers included in this bill.

Status: Vetoed by the Governor

AB 56 (Portantino)- Mammographies
Requires health plans and health insurers to provide coverage for mammography upon provider referral of a participating nurse practitioner, participating certified nurse-midwife, or participating physician by July 1, 2010. This bill also requires health plans and health insurers to notify female enrollees or insureds of their eligibility for testing. CAPA amendments have added physician assistants to the list of health care providers that can provide the referral.

SB 797 (Pavley)- Bisphenol A; Product Safety
This bill prohibits, beginning in 2011, the sale, manufacture or distribution of a bottle or cup or a liquid, food, or beverage in a can, jar or plastic bottle that contains bisphenol A (BPA) if the item is primarily intended for children three years of age or younger. This bill also repeals this prohibition if the CA Dept. of Toxic Substances Control (CDTSC) adopts a regulatory response, pursuant to current “Green Chemistry” law, regarding the use of bisphenol A.
